Terms and Conditions
1. Service Description
The Personalised Coaching Package is a non medical nutrition and lifestyle coaching service provided by The Basic Nutritionist. All information and guidance provided is educational in nature and does not constitute medical advice, diagnosis, or treatment.
No outcomes, results, or improvements are guaranteed.
2. Delivery of Services
All services within this package are delivered online unless otherwise agreed in writing.
Any in person meetings, consultations, or physical meet ups are not included in the package fee and may be subject to an additional charge, which must be agreed prior to delivery.
3. Client Commitment and Cooperation
The client acknowledges that the effectiveness of the coaching service depends on their active participation, honesty, and willingness to implement recommended lifestyle and behaviour changes.
Failure to engage, comply, or participate does not constitute a breach of contract by The Basic Nutritionist and does not entitle the client to a refund.
4. No Refunds and Early Termination
Due to the personalised nature of this service, all fees are non refundable once the package has commenced.
If the client terminates the agreement before the end of the agreed coaching period for any reason, no refund, credit, or partial refund will be issued.
5. Scope of Services and Additional Work
The package includes only the services expressly stated at the time of purchase.
Any additional work requested or required outside the agreed scope of the package, including but not limited to additional consultations, written materials, revisions, reviews, or ongoing support, is not included and will be chargeable. Fees for additional work will be confirmed in advance.
6. Disclosure of Health Information
The client warrants that all health related information provided during the initial consultation is complete, accurate, and truthful, including but not limited to medical conditions, allergies, intolerances, medications, and relevant health concerns.
The Basic Nutritionist shall not be held responsible or liable for any adverse effects, reactions, or outcomes resulting from information not disclosed or inaccurately disclosed by the client.
The client agrees to notify The Basic Nutritionist promptly of any changes to their health status during the coaching period.
7. Medical Responsibility and Risk Acknowledgement
The client acknowledges that they are solely responsible for their health and wellbeing and for seeking medical clearance where appropriate.
The Basic Nutritionist does not assume responsibility for medical decision making or health outcomes arising from the implementation of provided guidance.
8. Intellectual Property
All content, materials, resources, and documents provided remain the intellectual property of The Basic Nutritionist.
The client is granted a limited, non transferable, revocable licence to use such materials for personal use only. Redistribution, reproduction, or commercial use is strictly prohibited without prior written consent.
9. Communication Boundaries
Support is provided within agreed communication methods and timeframes. The Basic Nutritionist does not guarantee response times outside these agreed parameters.
10. Limitation of Liability
To the maximum extent permitted by law, The Basic Nutritionist shall not be liable for any loss, damage, injury, or adverse outcome, whether direct or indirect, arising from participation in the coaching package or reliance on information provided.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
12. Acceptance
By purchasing and commencing the Personalised Coaching Package, the client confirms that they have read, understood, and agreed to be legally bound by these Terms and Conditions.
Terms and conditions – COURSES 2024
This document constitutes a contract between you and THE BASIC NUTRITIONIST
You should read these terms and conditions carefully and raise any questions and concerns that you have.
The contract is concluded once you have booked onto THE BASIC COURSES and have checked the box "I have read and understood the terms and conditions and the disclaimer and if THE BASIC NUTRITIONIST does not decline your booking within 48 hours.
The client agrees to pay fees for the service on the terms and conditions set out below. In return for the fees payable by the client (or by a third party on their behalf), THE BASIC NUTRITIONIST agrees to provide the service in accordance with the terms and conditions set out below.
1. Services: COURSES
1.1. A description of the COURSES together with the dates on which the course will begin are available on our website.
1.2. The services to be provided by THE BASIC NUTRITIONIST is nutrition and lifestyle advice and does not constitute medical diagnosis or any type of therapy or clinical treatment and should not be construed as such.
1.3.THE BASIC NUTRITIONIST will provide the COURSES with reasonable care and skill in accordance with the description set out on the website.
1.4.The COURSES has been designed to be up to date and based on available evidence at the time of teaching.
1.5.THE BASIC NUTRITIONIST makes no guarantees regarding the results that you will see from attending the COURSES or using the information provided. Reliance on any information provided by THE BASIC NUTRITIONIST is solely at your own risk.
2. Payment and fees
• 2.1. The fees for COURSES shall be as set out on the website.
• 2.2. Payment must be made in advance of the COURSES starting via the online payment and booking system on the website (www.thebasicnutritionist.co.uk).
3. Cancellations by THE BASIC NUTRITIONIST and refunds
• 3.1 THE BASIC NUTRITIONIST reserves the right to vary or withdraw any of the courses described on the website without notice.
• 3.2 If for any reason THE BASIC NUTRITIONIST cancels a course, you will be notified as soon as possible and THE BASIC NUTRITIONIST will try to offer you an alternative date. If the course is no longer available you will be entitled to a full refund. Please note that you are made aware of the fact that all courses require a minimum number of participants to run.
• 3.3 It may be necessary for course times and dates to be changed. If the new time or date is not convenient to you THE BASIC NUTRITIONIST will try to offer you an alternative, but no guarantee is made that THE BASIC NUTRITIONIST will be able to find a new time or date that works for all course participants. If THE BASIC NUTRITIONIST is unable to find a suitable alternative date and time you will be entitled to a refund.
4. Cancellations by the client and refunds
• 4.1. A 75% refund will be issued where the participant cancels, in writing, 4 weeks or more before the start date of their course. A 50% refund will be issued where the participant cancels, in writing, 2-4 weeks before the start date of their course.
• 4.2. Aside from the situations described in paragraph 4.1, no refunds can be issued for cancellation by a seminar/bootcamp participant although THE BASIC NUTRITIONIST may, in its sole and absolute discretion, offer a full or pro rata refund in exceptional circumstances.
• 4.3. Courses that cannot be completed due to technical problems on your side (including, but not limited to, lost internet connection) will be charged as normal.
5. Termination
• 5.1. THE BASIC NUTRITIONIST shall be entitled to terminate these terms and conditions and cease to provide you with any services with immediate effect in the event that you:
• fail to pay when due your fees;
• act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee or collaborator of THE BASIC NUTRITIONIST, any teacher or lecturer who provides the courses or any other parent who attends any courses;
• steal or act in fraudulent or deceitful manner towards our employee or collaborator of THE BASIC NUTRITIONIST, any teacher or lecturer who provides courses or any student who attends any courses; are in other breach of these terms and conditions.
• 5.2. On termination the responsibility and liability clause and confidentiality clause shall continue
notwithstanding such termination.
6. Photography and Video
6.1. THE BASIC NUTRITIONIST will record all zoom sessions for training and quality purposes – THE BASIC NUTRITIONIST will make you aware of this at the start of the course.
6.2. From time to time THE BASIC NUTRITIONIST may request to take photographs or shoot video during seminar/bootcamp to use for marketing and promotional purposes, which may include, but is not limited to, use on social media, promotional materials or our website.
6.3. You will be asked whether or not you consent to being included in these images or footage. Where images are used in this way no additional personal information or names will be linked to them, unless specific additional permission is sought from the individuals involved.
7. Confidentiality
• 7.1. During question-and-answer time, sensitive and personal information can be shared and so confidentiality is important. You must be comfortable sharing any information you disclose directly to the group during a course.
• 7.2. Questions can be asked directly to your course lead via a direct zoom message and this question can then be answered anonymously. In this instance any information you share will remain confidential between your course lead and yourself.
8. Exceptions to confidentiality are as follows:
• Where you give your consent for information you have disclosed to be shared with a third party;
• Where the course lead are compelled to by regulation or law; or
• Where the information is of such gravity that confidentiality cannot be maintained. This includes instances in which your seminar/bootcamp lead considers in their sole discretion the client or others could be in immediate danger; or
• Where the situation concerns a safeguarding issue regarding the welfare of a minor.
• 9.1. All Intellectual Property Rights in the seminar/bootcamp materials are, and remain, the THE BASIC NUTRITIONIST’s property or its licensors, whether adapted, written for or customised for the client or not.
• 9.2. You are not authorised to:
• copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the seminar/bootcamp materials without THE BASIC NUTRITIONIST's prior written permission;
• record on video or audio tape, relay by videophone or other means the seminar/bootcamp;
• use the course materials in the provision of any other course or training whether given by us or any third party;
• remove any copyright or other notice of THE BASIC NUTRITIONIST on the seminar/bootcamp materials;
• 9.3. Breach by you of this clause shall allow us to immediately terminate our contract with you and cease to provide you with any services. THE BASIC NUTRITIONIST reserves the right to seek compensation for any damages.
10. Data Protection
• 10.1. Under this contract, THE BASIC NUTRITIONIST will obtain, use and disclose (together “Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By booking onto a seminar/bootcamp you agree to this Use.
• 10.2. When you register with THE BASIC NUTRITIONIST you will need to provide certain Data such as your contact details and demographic information. THE BASIC NUTRITIONIST will store this Data and use it to contact you, provide you with details of the course you have booked onto.
• 10.3. THE BASIC NUTRITIONIST will not pass any personal data on to any one.
• 10.4. THE BASIC NUTRITIONIST endeavour to take all reasonable steps to protect your personal Data, but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on- line over the internet and will not hold us responsible for any breach of security.
11. Complaints
Please contact THE BASIC NUTRITIONIST in the first instance should you wish to discuss any aspect of your care or this contract.
12. Applicable law and jurisdiction
These Terms and Conditions are governed by UK law, to the exclusion of any other foreign legislation.
